1. Acceptance

By accessing burmaxenergy.com (the “Site”) you agree to these Terms of Use. If you do not agree, please do not use the Site.

2. What these terms cover

These terms govern your use of the Site. They are not your installation agreement. Any solar system we design, sell, finance or install for you is governed exclusively by the separate written contract you sign, together with the manufacturer's warranty documents. Where this Site and that contract differ, the signed contract controls.

3. The Site is informational

Everything on the Site — including descriptions of services, savings, warranty terms, financing options and eligibility — is general information for marketing purposes. It is not an offer, a quote, a guarantee of savings, or a promise that you will qualify for any particular financing programme.

Solar system performance and savings depend on your roof, shading, orientation, consumption, utility rate schedule, and applicable incentives, all of which vary. Financing approval is determined by the relevant lender or programme, not by us. Nothing here is financial, tax or legal advice — consult a qualified professional about tax credits and incentives.

4. Quotes and pricing

A binding price is only ever provided in a written proposal we prepare for your specific property. Prices, incentives and programme terms referenced on the Site may change without notice.

5. Intellectual property

The Site and its contents — text, layout, design, graphics, the Burmax Energy name and logo, and photographs of our installations — are owned by Burmax Energy or used with permission, and are protected by copyright and trademark law. You may view and print pages for your own non-commercial use. You may not copy, republish, scrape or use our content or images commercially without our written permission.

Third-party marks such as SunPower, SunRun, SolarEdge and Yelp belong to their respective owners and are referenced descriptively.

6. Customer reviews

The reviews shown on the Site are excerpts from our public Yelp listing, attributed to their authors and linked to the source. They are the opinions of the individuals who wrote them and reflect those customers' experiences, which are not a guarantee of the results you will get. The full reviews are available on Yelp.

7. Acceptable use

You agree not to:

• Use the Site unlawfully, or to harass, defraud or impersonate anyone
• Attempt to gain unauthorised access to the Site, its host, or any connected system
• Introduce malware, or interfere with the Site's operation or availability
• Scrape or harvest content or images at scale, or use automated means to overload the Site

8. Third-party links

The Site links to third parties such as Yelp, Facebook and Google Maps. We do not control those sites and are not responsible for their content, accuracy or practices.

9. Disclaimer of warranties

The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

This disclaimer applies to the Site only. It does not limit, and has no effect on, the warranties in your signed installation contract or the manufacturer's 25-year product warranty.

10. Limitation of liability

To the fullest extent permitted by law, Burmax Energy will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising out of your use of the Site. Nothing in these terms excludes liability that cannot lawfully be excluded — including liability for fraud, personal injury caused by negligence, or rights you have under California consumer protection law.

11. Governing law

These terms are governed by the laws of the State of California without regard to its conflict-of-laws rules. Disputes relating to the Site are subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.

12. Changes

We may update these terms. The date at the top of this page shows when they last changed, and continued use of the Site after a change means you accept the updated terms.
